Terms and Conditions of Use

Article 1 (Purpose)

These Terms and Conditions are provided by wecare4u.shop (hereinafter referred to as "Shop") operated by MEGA’GEN IMPLANT Co., Ltd.
The purpose of this document is to define the rights, obligations and responsibilities of the Shop and Users of the Shop.

These Terms and Conditions shall apply mutatis mutandis to electronic transactions using PC communications, etc.

Article 2 (Definitions)

  • "Shop" refers to a virtual business place that is set up so that we can trade goods or other information using information and communication facilities such as computers and mobiles to provide goods or services to Users. In addition, it is also used as a business operator operating a cyber mall.
  • "User" refers to members and non-members who access the Shop and receive the services provided by the Shop in accordance with these Terms and Conditions.
  • The term "Member" refers to a person who has provided personal information to the Shop and registered as a member of the Shop and can continuously use the services provided by the Shop.
  • "Non-member" refers to a person who uses the service provided by the Shop without registering for membership.

Article 3 (Specification and Amendment of Terms)

  • The Shop posts on the initial service screen so that Users can know the contents of these Terms and Conditions and the company name, business location, the name of the representative, the business registration number, and contact information (telephone, fax, e-mail address, etc.).
  • The Shop may amend these Terms and Conditions to the extent that it does not violate the relevant laws such as Law on regulation of terms and conditions, Basic Act on Electronic Documents and Electronic Transactions, Electronic Signature Law, Act on Promotion of Information and Communications Network Utilization and Information Protection, Law on Visiting and Sales, Basic Consumer Law, Consumer Protection Law on Electronic Commerce, etc..
  • In case these Terms and Conditions are amended by the Shop, the amended Terms, the current Terms, the applicable date and reason for amendment shall be noticed on the initial screen of the Shop from 7 days before the application date to the day before the application date
  • The amended terms will apply only to the contracts entered after the effective date of the amendment. However, if the User who has already entered into the contract notify that the User wants to be subject to the amended terms to the Shop within the notice period under Paragraph 3 and obtain consent of the Shop, the amended terms shall apply to the contract.
  • The matters not defined in these Terms and Conditions and the interpretation of these Terms and Conditions shall be governed by the Electronic Commerce Consumer Protection Guideline established by the Fair Trade Commission and related laws or practices.

Article 4 (Provision and Change of Service)

  • The Shop performs the following tasks:
    • 1.Provide information on goods or services and conclude purchase contracts;
    • 2.Delivery of the goods or services for which the purchase contract is concluded;
    • 3.Other duties designated by the Shop.
  • The Shop may change the contents of goods or services to be provided by future contracts in the event of the sold out of goods or the change of technical specifications. In this case, the Shop shall notify the content and date of the changes from the 7th day before the date of the change.

Article 5 (Suspension of Service)

  • The Shop may temporarily suspend the provision of services in the event of maintenance, replacement or breakdown of information and communication facilities such as computers, or interruption of communication.
  • In case of suspension of service under Paragraph 1, the Shop shall notify the suspension to Users by the method set out in Article 8.

Article 6 (Membership)

  • User applies for membership by submitting membership information according to the registration form established by the Shop and indicating that the User agrees to these terms.
  • The Shop shall register as a member of the Users who apply to join as a member as described in Paragraph 1 unless they fall under the following subparagraphs:
    • 1.in case the applicant has previously lost his/her membership pursuant to Paragraph 3 of Article 7 of these Terms and Conditions; except the case that three years passed from the loss of membership under Paragraph 3 of Article 7 and he/she obtains consent of the Shop about rejoin;
    • 2.in case there is false information, omissions, or errors in registration details;
    • 3.in case the membership registration is judged to be significantly difficult in light of the technology of the Shop.
  • The time of establishment of membership contract is when the approval of the Shop reaches the member.
  • If there is any change in the registration details pursuant to Paragraph 1, the member shall notify the Shop about the change immediately by e-mail or other means.

Article 7 (Withdrawal of Membership and Loss of Qualification)

  • A member may request withdrawal from membership at any time, and the Shop shall withdraw immediately.
  • If a member falls under any of the following, the Shop may restrict or suspend membership
    • 1.in case the member registered false information at the time of application;
    • 2.in case the member does not fulfill payment obligations in connection with the use of the Shop such as the purchase of goods or services on the due date;
    • 3.in case the member threatens the Electronic Commerce order, such as interfering with another person’s use or stealing the information;
    • 4.in case the member violates the laws and regulations or public order and morals using the Shop.
  • The Shop may disqualify the above restricted or suspended membership if the same act is repeated more than once, or if the reason of restriction or suspension is not corrected within 30 days.
  • If the Shop disqualifies the membership, the membership registration will be canceled. In this case, the Shop shall notify the member of the cancellation of membership registration and give the member the opportunity to justify before the cancellation.

Article 8 (Notice to Members)

  • When the Shop notifies the member, it can be done by the e-mail address that the member submits to the Shop.
  • The individual notice can be replaced by posting on bulletin board of the Shop for more than one week in case of the notice to many unspecified members.

Article 9 (Application for Purchase)

  • Users apply for purchases on the Shop by the following methods:
    • 1.Entering name, address, and phone number;
    • 2.Selecting goods or services;
    • 3.Selecting goods or services;
    • 4.Indicating acceptance of these Terms and Conditions.

Article 10 (Establishment of Contract)

  • The Shop shall agree to the purchase application according to Article 9 unless it falls under the following cases:
    • 1.in case there is false information, omissions, or errors in the purchase application details;
    • 2.in case a minor tries to purchase goods and services prohibited by the Youth Protection Act, such as tobacco and alcohol;
    • 3.in case that giving consent to the purchase application is judged to be significantly difficult in light of the technology of the Shop.
  • The purchase shall be deemed to have been established at the time when the consent of the Shop reaches the User in the form of receipt acknowledgment notice in Paragraph 1 of Article 12.

Article 11 (Method of Payment)

  • The payment method for goods or services purchased at the Shop may be one of the following:
    • 1.Credit card payment.
    • 2.Electronic payment through PayPal.

Article 12 (Receipt Acknowledgment Notice, Change and Cancellation of Purchase Application)

  • The Shop that received the User's purchase request shall notify User of the receipt.
  • If the intentions do not match, User who received the Acknowledgment Notice can request to change or cancel the purchase application immediately upon receiving the notification.
  • If there is a request for a change or cancellation of User's purchase application prior to delivery, the Shop shall process the request without delay.

Article 13 (Delivery)

The Shop separately specifies the delivery method, delivery cost bearer, and delivery period for the goods purchased by the User. In the case of a request for a change or exchange due to the consumer's change of mind, the consumer bears all the shipping costs.

Article 14 (Refund, Return and Exchange)

  • When the Shop is unable to deliver goods or provide services for which the User has applied for purchase, for reasons such as out of stock, the Shop shall notify the User of the reason without delay. And then, the Shop shall perform contract cancellation and refund procedures within 3 business days from the date of receipt of the payment if the goods or services are received in advance, otherwise within 3 business days from the date of occurrence of the reason.
  • In the following cases, the Shop immediately shall refund or exchange the goods according to the User's request within 3 business days after the goods are returned. However, the deadline is 30 days from the date of delivery to the User:
    • 1.in case the delivered goods are different from the order contents or the information provided by the Shop;
    • 2.in case the delivered goods are damaged or contaminated;
    • 3.in case the goods are delivered later than the delivery period indicated in the advertisement;
    • 4.in case the User's subscription is made without displaying what to be displayed in the advertisement pursuant to Article 18 of the Act on Visiting Sales, etc.

Article 15 (Privacy Policy)

  • In order for the Shop to collect and use personal information, it shall first inform the User of the purpose and obtains consent. Thereafter, the Shop shall collect only the minimum amount of personal information necessary for the purpose. If a new purpose of use occurs or if it is provided to a third party, the Shop shall notify the User of the purpose and obtains consent before use or provision. However, exceptions are made in other cases as stipulated by applicable laws.
  • The Shop shall not use the User's personal information for purposes other than the above.
  • The Shop shall be responsible for reimbursing the User for damages caused by leaking the User's personal information or using it for other purposes.
  • When the Shop and the third party who received personal information from it have achieved the purpose of collecting or providing personal information, the personal information shall be destroyed by the Shop or the third party.

Article 16 (Duty of Shop)

  • The Shop shall strive to not perform acts that prohibited by laws and regulations or contrary to public order and morals, and to provide goods and services consistently and stably as prescribed by these Terms and Conditions.
  • The Shop shall build a security system to protect the User's personal information (including credit information) so that User can safely use the Internet service.
  • The Shop shall be responsible for reimbursing the User for any damages due to the unjustified display and advertisement of Article 3 of the 「Act on Fairness of Display and Advertisement」 for products and services.
  • The Shop shall not send advertising e-mail for commercial purposes that Users do not want.

Article 17 (Obligations for Member ID and Password)

  • Except in the case of Article 15, the member is responsible for managing ID and password.
  • Members shall not let their third parties use their ID and password.
  • If a member recognizes that his ID and password are stolen or used by a third party, the member shall notify the Shop immediately and follow the Shop's instructions.

Article 18 (Obligations of Users)

  • Users shall not do the following actions. The Shop is not responsible for any damage caused by User's following actions:
    • 1.Registration of false information when applying or changing;
    • 2.Change of information posted in the Shop;
    • 3.Sending or posting information (computer programs, etc.) other than the information specified by the Shop;
    • 4.Infringement of intellectual property rights such as copyrights of Shops and other third parties;
    • 5.Acts that damage the reputation of the Shop or other third parties or interfere with business;
    • 6.Disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals in the Shop

Article 19 (Attribution of Copyright and Restrictions on Use)

  • Copyright and other intellectual property rights to works created by the Shop shall belong to the Shop.
  • Users shall not use and not let a third party use the information obtained through the use of the Shop and attributed to the intellectual property to the Shop for commercial purposes by copying, sending, publishing, distributing, broadcasting or other methods without prior consent from the Shop.

Article 20 (Dispute Settlement)

  • The Shop shall do its best to reflect the legitimate opinions or complaints raised by Users and to compensate for the damages.
  • The Shop preferentially handles complaints and opinions submitted by Users. However, in case it is hard to process promptly, the Shop shall notify the User of the reason and schedule immediately.
  • Disputes between the Shop and User may be settled according to the mediation of the Electronic Documents and Electronic Transaction Dispute Mediation Committee established under Article 32 of the Framework Act on Electronic Documents and Electronic Transactions.

Article 21 (Jurisdiction and Governing Law)

  • Lawsuits related to e-commerce disputes between the Shop and User shall be brought to the competent court under the Civil Procedure Act.
  • Lawsuits related to e-commerce disputes between the Shop and User shall be governed by the laws of the Republic of Korea
(Effective date) The above Terms and Conditions shall go into effect from June 2020.
